§ 1.

General information

  1. These regulations define the rules for the provision of services via the Internet Platform located at: www.parisoptique.pl, which consist of:

    • - sale of products as part of the Paris Optique online store;

    • - maintaining an Account for the Customer;

    • - online booking of visits to Salons;

    • - providing digital content.

  1. The Internet platform is run by “Optyk Serwis i Marketing Sp. z o.o.” with its registered office in Warsaw, ul. Pory 78, 02-757 Warsaw, NIP 521-36-35-251, (hereinafter “Paris Optique” or “Administrator”).

  1. For matters relating to the Online Platform, the products offered, a visit or an order, you can contact Paris Optique via the e-mail address: contact@parisoptique.pl.

  1. Using the Internet Platform, including browsing the assortment in the Paris Optique Online Store, ordering products as part of the Paris Optique On-line Store, booking the Free Eye Exam service does not require registration or setting up an Account on the Online Platform by the User.

  1. Paris Optique does not charge for registration and setting up an account on the Internet Platform, including for browsing the offer of the Paris Optique Online Store, or for booking appointments, with the proviso that using the Internet Platform requires access to the Internet. In turn, obtaining access to the Internet may involve the need to pay fees to the provider of this service.

  1. Paris Optique, as part of the Online Platform, collects payments for goods purchased by the Customer in the Paris Optique Online Store.

§ 2.

Definitions

Administrator – this is Paris Optique

Free Eye Test – this is a free eye examination service offered by Paris Optique, the reservations of which can be made via the Internet Platform, the examination takes place in Paris Optique stationary salons throughout Poland.

  1. For matters relating to the Online Platform, the products offered, a visit or an order, you can contact Paris Optique via the e-mail address: contact@parisoptique.pl.

  1. Using the Internet Platform, including browsing the assortment in the Paris Optique Online Store, ordering products as part of the Paris Optique On-line Store, booking the Free Eye Exam service does not require registration or setting up an Account on the Online Platform by the User.

  1. Paris Optique does not charge for registration and setting up an account on the Internet Platform, including for browsing the offer of the Paris Optique Online Store, or for booking appointments, with the proviso that using the Internet Platform requires access to the Internet. In turn, obtaining access to the Internet may involve the need to pay fees to the provider of this service.

  2. Paris Optique Online Shop Hotline – telephone hotline at the number 666 022 219 through which you can contact the Paris Optique Online Store. The fee for connection to the Helpline is as for a local call or according to the rates of the mobile network operator.

    Paris Optique general hotline &ndash ; telephone helpline at the number 666 022 219, through which general information can be obtained. The fee for connection to the Helpline is as for a local call or according to the rates of the mobile network operator.

    Guest – this is the Customer who uses the functionalities offered by the Internet Platform without registering an Account on the Internet Platform. It is possible to use the services of the Online Platform by a Registered Customer as a Guest, i.e. when the Registered Customer does not log in to his Customer Account – a natural person who is a consumer within the meaning of art. 221 of the Civil Code, which uses the Internet Platform, including the Paris Optique online Service, in order to use the services offered by Paris Optique via the Internet Platform

    Account – an individual account available after the Customer's registration, constituting a collection of data concerning the Customer and information about the Customer's orders placed on the Internet Platform. As part of the Account, the Customer has the option, among others, to manage his personal data, invoice data and view placed orders, as well as to delete his Account.

    Internet Platform – Internet platform located at: www.parisoptique.pl through which Paris Optique provides the following services:

      • - sale of products as part of the Paris Optique Online Service;

      • - maintaining an Account,

      • - online booking of visits to Salons;

      • - browsing online the products available in the Paris Optique online store;

      • - delivering digital content Privacy Policy – a set of rules regarding the processing and protection of personal data of users of the Internet Platform, including customers of the Paris Optique online service, available at:

        and constituting an integral part of these Regulations

    Terms and Conditions – these regulations for the Paris Optique online Platform, which define the rules for the provision of services via the Internet Platform, which include:

      • - sale of products as part of the Paris Optique online store;

      • - maintaining an Account for the Customer

      • - online booking of visits to Salons;

      • - providing digital content.

    Sales – optical salons run by Paris Optique under the “Paris Optique” brand. The list of Paris Optique salons can be found on the website: https://parisoptique.pl/salony

    Paris Optique Online Service or Paris Optique Online Shop – a service provided via the Internet Platform, which consists of the sale of products in the “Paris Optique” online store, located at: https://parisoptique.pl.

    Visit – this is the possibility of booking an appointment at a selected stationary salon in order to perform a Free Eye Examination in the Paris Optique chain of salons and consultation with a specialist and advisor on the selection of eyeglass lenses.

    Client – this is the Customer who has registered his Account on the Online Platform. Using the services of the Internet Platform in the “Registered Customer” requires a Registered Customer to log into their Account

    § 3.

    Rules for using the Online Platform

    1. The operation of the Internet Platform takes place using an ICT system that ensures processing and storage, as well as sending and receiving data, on the terms set out in the documents available at the addresses:

    2. To ensure the safety and convenience of using the Internet Platform, the Customer should have a device that meets certain standards:

        • - an active connection to the Internet allowing for two-way communication via the HTTPS protocol;

        • - a properly installed web browser that supports the HTML 5 standard and Cascading Style Sheets (CSS3) technology;

        • - enabled Java Script and cookies (usually enabled by default in the browser);

        • - active own e-mail address (in order to order products in the Paris Optique Online Store or to order a Visit to the Salon via the Internet Platform);

        • - an active mobile phone number (in order to receive text messages about the execution of the order as part of the Paris Optique online Service).

        • - online store on htttps://parisoptique.pl works in RWD technology

    3. The Customer undertakes not to take any actions that could affect the proper functioning of the Online Platform, including

      • - not to interfere with the content of the Internet Platform website, its technical elements, or the accounts of other Customers;
          • - not to provide untrue, non-own data, or to use other people's accounts or payment instruments or financial means to fulfill orders on the Internet Platform.

          • - The customer undertakes not to provide content that is unlawful or contrary to good manners.

    4. Paris Optique is not responsible for disruptions, including interruptions in the functioning of the Internet Platform, caused by the incompatibility of the Customer's technical infrastructure with the Internet Platform operated by Paris Optique.

    § 4.

    Client

    1. As part of the Paris Optique online service, orders may be placed by a Customer who meets the following criteria:

      • - is over 18 years old and has full legal capacity;

      • - places orders as a consumer within the meaning of art. 221 k.c.

    2. The Customer does not need to have an Account to be able to use the Online Platform, including placing orders for sunglasses under the conditions described in these Regulations. The Paris Optique service enables placing orders on the Online Platform by Customers who have a registered Account on the Online Platform (hereinafter “Registered Customer”), as well as by Customers who have not registered an Account on the Online Platform (hereinafter “ Guest”).

    3. Subject to the provisions of paragraph 4 sec. 2 above, the Customer may place an order in the following way:

        • - as a Registered Customer – after the Customer registers an account on the Online Platform and logs into his account;
          • - as Guest – in the “Buy without registration” formula, i.e. without the need to register an account on the Internet Platform (or log in to the account) after meeting the conditions set out in §9 sec. 4 below.

    § 5.

    Account Registration on the Internet Platform

    1. Paris Optique provides Customers with the option of setting up an Account on the Internet Platform. The account is available after the Customer's registration on the Internet Platform. The Account is a collection of data concerning the Customer about the Customer's orders placed on the Internet Platform, under which the Customer has the option, among others, to manage his personal data, invoice data, place orders for products as part of the Service Paris Optique online, ordering Free Eye Examination Appointments and viewing previously placed orders. The Customer may delete his/her Account from the Online Platform in accordance with § 6 sec. 7 and 8 of the Regulations.

    2. The Customer may register an Account on their own within the Online Platform.

    In order to register an Account by the Customer in the manner referred to above, it is necessary for the Customer to complete the registration form, which is available on the Internet Platform website when placing an order by:

        • - providing the following data: name and surname, e-mail address, postal address, contact phone number and password;

        • - submitting a statement about reading the Regulations of the Internet Platform, the Privacy Policy and the Complaints Policy and accepting their provisions (by clicking the appropriate box of the registration form);

        • - submitting a declaration of will regarding consent to the processing of personal data referred to in order to fulfill the order placed by the Customer or to maintain the Account and make purchases through it as part of the Paris Optique online Service (via clicking on the appropriate box of the registration form);

    3. Notifications regarding the use of the Account will be sent to the e-mail address provided by the Customer in the registration form referred to in paragraph 5 sec. 2 above. The Customer should verify on an ongoing basis whether the e-mail address provided by him for the purpose of setting up the Account is up-to-date and correct. The Customer should not share or disclose his Account password to third parties.

    4. Paris Optique offers the Customer the opportunity to obtain support in the Account registration process. This support is available through the Helpline. In the case of supporting the Account registration process via the Hotline, the Paris Optique employee does not perform any activities for the Customer described in paragraph 5 sec. 2 above, and only helps the Customer to go through the Account registration process correctly.

    5. One natural person may have only one Account on the Internet Platform.

    6. If the digital service provided by Paris Optique in the form of maintaining an Account for the Customer remains inconsistent with the Account maintenance agreement, i.e. with these Regulations, the Customer may submit a statement of withdrawal from this agreement when:

      • - bringing the digital service into compliance with the contract (i.e. the Regulations) is impossible or requires excessive costs on the part of Paris Optique;

      • - Paris Optique failed to bring the digital service into compliance with the contract (Regulations);

      • - the lack of compliance of the digital service with the contract (Regulations) persists, even though Paris Optique has tried to bring it into compliance with the contract;

      • - the lack of compliance of the digital service with the contract (Regulations) is significant enough to justify withdrawal from the contract (Regulations);

      • - it is clear from Paris Optique's statement or circumstances that it will not bring the digital service into compliance with the contract (Regulations) within a reasonable time or without undue inconvenience to the Customer.

    1. In order to withdraw from the contract for the maintenance of the Account, an email should be sent to the following address: contact@parisoptique.pl, containing a request to withdraw from the contract for the maintenance of the Account. The account is deleted immediately after receiving the above-mentioned message, but not later than within 14 days from this date. Withdrawal from the contract for maintaining the Account always means deleting the Account (contract for the provision of electronic services). Withdrawal from the contract for maintaining the Account does not mean that Paris Optique deletes all the Customer's personal data processed as part of the deleted Account, if there are other legal grounds for their processing by Paris Optique after the date of withdrawal from the above-mentioned contract; in such a situation, Paris Optique will process the Customer's personal data only on the basis of generally applicable laws and for the purpose of Paris Optique's legal obligation.

    § 6.

    Rules for using the Account

    1. The Customer should use the Account and other services of the Internet Platform in a manner consistent with applicable law, good practices and the provisions of the Regulations.

    2. After registering on the Online Platform, each time you log in to your account, use the Customer's data provided in the registration form, i.e.: e-mail address and password. The Customer may change the password assigned to the Account by using the Account functionality; changing the password requires the content of the old and new password. In the event that the Customer does not remember his password, the functionality of the Account allows him to reset it – After using this functionality, the Customer receives an email to the email address assigned to the Account, containing an activation link for changing the password.

    3. Paris Optique does not control or verify the Customer's data provided when setting up the Account.

    4. Registering an Account on the Internet Platform, as well as using the functionalities of the Internet Platform pages (including browsing products within the Paris Optique Online Store, using the Account) is free of charge.

    5. Paris Optique has the right to block the Account (i.e. prevent the Customer from accessing and modifying the Account) when the Customer uses the Account in violation of applicable law, third party rights, good practices or the provisions of these Regulations. Paris Optique will notify the Customer of the intention to block the Account by sending a message to the e-mail address indicated by the Customer. Blocking the Account means Paris Optique's termination of the contract with the Customer for the provision of electronic services regarding the Account with immediate effect. An order accepted for execution by Paris Optique before blocking the Account is subject to the rules of the “Buy as a guest” formula, referred to below.

    6. In the event of blocking the Account referred to in paragraph 6 sec. 5 above, the Customer may, within no more than 14 (fourteen) days from receiving the notification of blocking the Account, ask Paris Optique to provide the Customer's data stored in the Account, in particular copies of orders placed. Paris Optique will provide such data to the Customer in electronic form within no more than 14 (fourteen) days from the date of sending the request by the Customer.

    7. The Customer may delete his Account by sending an e-mail to the following e-mail address: contact@parisoptique.pl, containing a request to delete the Account. The account is deleted immediately after receiving the above-mentioned message, but not later than within 14 days. Deletion of the Account always means termination of the Account maintenance agreement concluded with the Customer (contract for the provision of electronic services). However, deleting the Account does not mean deleting all the Customer's personal data processed as part of the deleted Account by Paris Optique, if there are other legal grounds for their processing by Paris Optique after the date of termination of the above-mentioned agreement.

    8. After deleting the Account by the Customer, it is not possible to restore it. The agreement for the provision of electronic services regarding the Account expires when the Customer deletes the Account.

    § 7.

    Ways of Using Paris Optique On line Services

    1. The Paris Optique online store, located at: https://parisoptique.pl/ is run by “Optyk Serwis i Marketing Sp. z o.o.” with its registered office in Warsaw, ul. Pory 78, 02-757 Warsaw, NIP 521-36-35-2512. Browsing the pages and products of Paris Optique online does not require the creation of an Account by the user. The digital content provided by Paris Optique as part of the Online Platform can be viewed:

      • as a Registered Customer – after registering an Account on the Online Platform and logging into your Account;

    lub

      • as Guest – without the need to register an Account on the Online Platform.

    3. Registering an Account within Paris Optique online, as well as using the functionalities of the Paris Optique Online Service pages, including browsing products and using the Account, is free of charge.

    4. Browsing the pages of the Paris Optique Service online as a Registered Customer requires logging into the Account within the Online Platform. Logging into the Account is done by entering the e-mail address and password provided by the customer when registering the Account in the login form. With the exception of the email address assigned to the Account, the data provided when registering the Account may be changed after the Customer logs in to his/her Account

    5. Browsing the pages of the Paris Optique Service online, as a registered Customer, gives you the opportunity to use all available functionalities of the online store.

    § 8.

    Information about the products available in the Paris Optique On-line Service

    1. Paris Optique, as part of the Paris Optique Online Store, sells and delivers wholesome products.

    2. Paris Optique assumes responsibility towards the Customer for the lack of conformity of the goods purchased as part of the Paris Optique Online Service with the sales contract, existing at the time of its delivery and revealed within two weeks from that moment.

    3.The prices of all products available on the Paris Optique online website are gross prices (including VAT) and are expressed in Polish zlotys. Product prices do not include delivery costs. Delivery costs are given when choosing the method of product delivery by the Customer.

    4. Paris Optique reserves the right to change the prices of products offered in the Paris Optique online store, the cost of delivery of the order, post information about new products, withdraw products from the store's offer, carry out and cancel promotional campaigns on the Paris Optique online services or introduce changes to them in a manner that does not infringe the rights acquired by the Customer. Paris Optique confirms that the exercise of the rights referred to in the previous sentence does not affect the Order placed and accepted for execution by Paris Optique before the date of entry into force of a specific change.

    5. Each purchase is accompanied by a fiscal receipt or VAT invoice, depending on the Customer's choice.

    6. The final prices of products available in the Paris Optique online store may differ from the prices of the same products offered by Paris Optique in stationary stores.

    § 9.

    Placing and fulfilling orders

    1. Orders for the Paris Optique Online Service can be placed via the website: https://parisoptique.pl.

    2. Orders on the Paris Optique Online Service may be placed twenty-four (24) hours a day throughout the calendar year.

    3. The customer may place orders in the Paris Optique online store as:

          • Registered Customer (i.e. a Customer with an Account in the Paris Optique Online Store) – after the Customer logs into his Account;

    or

      • as a guest in the formula “Buy as a guest” – without the need to log in or register an Account on the Internet Platform on the terms set out in section 4 below.

    4. FORMULA “Buy as guest”.

    The requirement to register and use an Account does not apply to Customers using the option to place an order on the Paris Optique Service online in the “Buy as Guest” formula. In this case, the Customer, before placing an order, is obliged to complete the order form by providing:

        • your name;

        • Client's address and/or delivery address

        • email address;

        • contact phone number;

    and

    submission of the following statements:

    1) about reading the Regulations of the Internet Platform, the Privacy Policy and the Complaints Policy and accepting their provisions (by clicking on the appropriate box of the registration form);

    2) in the scope of expressing consent to the processing of personal data about the Customer's health in order to carry out the order/order placed by the Customer – (by clicking in the appropriate box of the registration form);

    Completion of the above-mentioned actions is necessary to place an order in the Paris Optique Online Service as a Guest. Otherwise, the ordering procedure is the same as when placing an order as a Registered Customer.

    5. The order is placed by selecting the products and placing them in the electronic “basket”, and then completing the order form.

    6. In order to place an Order, go to the “Basket” section, where the Customer should indicate the selected products and their quantity. After completing the Basket, select the delivery address (if ordering as a Registered Customer - if the delivery address is different from the address provided in the Account settings). After entering the delivery address, information about the delivery costs of the order will appear. After accepting the delivery costs of the order, information will appear summarizing the Customer's order, including information about:

    • ordered products and their quantity;

    • unit price of ordered products and their total price; and

    • order delivery costs (including information on the total amount to be paid, including the price of the ordered products and order delivery costs).

    7. To place an order on the Paris Optique Online Service, click on the “Order & Pay” button. The Customer's Order will be sent to Paris Optiuqe and the Customer will be redirected to the payment method selection page.

    8. After placing the order, Paris Optique online sends a confirmation of receipt of the Customer's order to the Customer's e-mail address (indicated in the Account or in the registration form when purchasing in the "Buy as a guest" formula). This confirmation will be sent immediately, and in any case no later than 48 hours after receipt of the order by Paris Optique Online. An order placed on non-working days will be processed on the first working day following the day on which the order was placed.

    9. Upon receipt of the order by Paris Optique, a contract for the sale of products indicated in the order is concluded with the Customer. The information sent about the confirmation of receipt of the order by Paris Optique is the Customer's declaration of acceptance of the offer referred to in paragraph 9 sec. 8 above.

    10. In the event that all ordered products are found to be unavailable, Paris Optique online will inform the Customer of the refusal to process the order due to the unavailability of the ordered products and will cancel the order. If the Customer pays for the canceled order, the provisions of paragraph 9 section 12 below.

    11. If only some of the Paris Optique products ordered online are found to be available, it is not possible to complete the purchase. In such a situation, the entire order placed by the Customer is automatically canceled, about which the Customer is informed via a message sent to the e-mail address provided by him. Paris Optique does not collect payment from the Customer for an unrealized order. The customer will be able to place a new order.

    12. Availability of product information on the Paris Optique online services means that these products are not available in Paris Optique online warehouses and the order cannot be fulfilled. In the event of unavailability of all or part of the product in the ordering process, Paris Optique will initiate notification to the Customer. In the event of cancellation of the Customer's order in accordance with the provisions of paragraph 9 para. 10 sec. 11 above, and in the case of price verification by the customer, Paris Optique will reimburse to the customer all payments made by him for the canceled order, i.e. no later than within 7 (seven) days from sending the information about canceling the order to the customer . Paris Optique refund using the same payment method used by the customer.

    13. After sending the Order, Paris Optique will provide the Customer by distribution to the e-mail address of the courier parcel number enabling its ”tracking” .

    14. In case of doubt as to the use of contact details, Paris Optique contacted the client or by e-mail to verify the data.

    12. The availability of product information on the Paris Optique Online Services pages does not imply the availability of these products in Paris Optique online warehouses and the ability to fulfill an order. In the event of unavailability of all or part of the products covered by the order, Paris Optique will immediately notify the Customer. In the event of cancellation of the Customer's order in accordance with the provisions of paragraph 9 para. 10 and sec. 11 above, and if the Customer pays the price, Paris Optique will immediately return to the Customer all payments made by him for the canceled order, i.e. no later than within 7 (seven) days from sending the information about the cancellation to the Customer orders. Paris Optique refunds the payment using the same payment method used by the Customer.

    13. After sending the Order, Paris Optique will provide the Customer by e-mail to the indicated e-mail address with the number of the courier parcel enabling its ”tracking” .

    14. In case of doubts as to the correctness of the contact details, Paris Optique will contact the Customer by phone or e-mail to verify the data.

    15. In the case of promotional sales and sales for which a limited number of products are intended, the order will be processed in the order in which confirmed orders for these promotional products are received, until the stocks covered by this form of sale are exhausted.

    16. Paris Optique offers the Customer the opportunity to obtain support in the ordering process through the Paris Optique Online Service. This support can be obtained during a visit to any Salon or via the Online Store Hotline. In the case of supporting the purchasing process via the Helpline, the Helpline employee may:

    1) explain to the Customer how to use the functionality of the Paris Optique online Service,

    2) the Helpline employee may not make any statements on behalf of the Customer or express any consents required as part of the purchasing process by the functionality of the Paris Optique online Service, and in particular the Helpline employee does not have the right to confirm the order;"> in the manner described in paragraph 9 section 7 above. The Customer is each time obliged to read the content of the Order before accepting it and to independently confirm its submission in the manner described in paragraph 9 section 7 above.

    § 10.

    Deliveries

    1. Deliveries of products purchased as part of the Paris Optique online Service are carried out by Paris Optique to delivery locations located only in the territory of the Republic of Poland.

    2. Orders are processed on working days (i.e. from Monday to Friday, excluding public holidays) from 7:00 to 15:00. The estimated delivery time stated on the Paris Optique Online Service pages is in working days.

    3. Orders placed on non-working days will be processed on the first working day following the day on which the order was placed.

    4. Paris Optique, as part of the Paris Optique online Service, delivers orders only via courier delivery to the address indicated by the Customer in the order,

    5. Deliveries are made for orders after the payment has been credited.

    6. Paris Optique is not responsible for non-delivery of the ordered product or delay in delivery caused by an incorrect or inaccurate address provided by the Customer.

    7. Delivery costs will be included in the receipt or invoice in accordance with the information displayed in the delivery option.

    8. The cost of delivery is indicated when completing the order form. When Paris Optique transfers the ordered product to the courier company, Paris Optique sends an e-mail to the Customer with a message about the shipment of the purchased products, along with information about the courier and the tracking number.

    § 11.

    Payment methods

    1. Paris Optique accepts electronic forms of payment as part of orders placed via the Online Store via Przelewy24

    The execution of the order will start no later than within 1 (one) business day after the conclusion of the contract. An order placed on non-working days will be processed on the first working day following the day on which it was placed

    2. Paris Optique online does not collect or process customer's payment card data; The Customer provides all data in this regard only to the Payment Operator.

    3. The payment method is selected when the Customer completes the order form.

    4. The moment of making the payment is considered to be a positive result of verification of the payment made.

    5. A payment initiated via the Payment Operator must be completed by the Customer, otherwise the Order will be canceled and the Order will not be processed.

    § 12.

    Withdrawal from the contract

    1. According to Art. 27 of the Act, the Customer has the right to withdraw from the sales contract for a product purchased in the Paris Optiuqe Online Service (subject to the provisions of section 12 and section 13 below) without giving any reason within 14 (fourteen) days from the date on which the Customer came into possession product, or which a third party other than the carrier and indicated by the Customer came into possession of the product.

    2. In the event of exercising the right of withdrawal, the Customer is obliged to inform Paris Optique about it within the time limit indicated in paragraph 1 above. To keep the 14-day deadline, it is enough for the Customer to send a statement before its expiry. A declaration of withdrawal from the contract can be submitted using the form, the model of which is available on the website at the address: www.parisoptique.pl/dokumenty/formularz_odstapienia_od_umowy_zawartej_na_odleglosc.pdf( (WITHDRAWAL FROM A DISTANCE AGREEMENT/RETURN OF GOODS PURCHASED IN THE ONLINE STORE) but it is not obligatory.

    3. Paris Optique accepts the withdrawal from the contract by sending a statement of withdrawal from the contract by the Customer to the e-mail address: contact@parisoptique.pl;

    4. Paris Optique will send a confirmation of receipt of the statement of withdrawal from the contract to the Customer's e-mail address immediately after receiving it, in any case not later than 48 hours from receipt of the Customer's statement. Confirmations of receipt of the Statement submitted on non-working days will be sent on the first business day following the day on which the Statement was submitted

    5. Subject to the reservation in paragraph 12 sec. 11 below, the Customer may withdraw both for the entire order (and then the withdrawal will be effective for all products included in the order), as well as for some only products included in the order termination (and then the contract will continue to apply to other products included in the order, for which the withdrawal from the contract has not been performed), unless otherwise stipulated in the terms of the promotional campaign conducted by Paris Optique under which the product was purchased.

Paris Optique is obliged to immediately, no later than within 14 days from the date of receipt of the Customer's statement of withdrawal from the contract, return all payments made by the Customer for the purchase in the Paris Optique Online Store. Paris Optique may, however, withhold the reimbursement of payments received from the Customer until the products are returned or the Customer provides proof of their return and verification of the factual status of the returned products.

    7. Paris Optique refunds the payment using the same payment method used by the Customer.

    8. The customer is obliged to complete the WITHDRAWAL FORM FROM THE AGREEMENT CONCLUDED AT A DISTANCE/RETURN OF GOODS PURCHASED IN THE ONLINE STORE, receivedy with the purchased goods or available download here and return the product, with no traces of use, together with all trademarks, original proof of purchase, case and unopened packaging with a microfibre cloth, for which he withdrew from the contract with Paris Optique, immediately, but not later than within 14 days of the day on which he withdrew from the contract with Paris Optique. To meet this deadline, it is enough to send the product before its expiry.

    9. The direct cost of returning the product is borne by the Customer.

    10. The customer is responsible for the decrease in the value of the product as a result of using the product in a way that goes beyond the nature, features, purpose and functioning of the product.

    11. In the event of withdrawal from the contract regarding a product that was purchased by the Customer as part of a promotional set (e.g. where the products offered as part of such a promotional set are sold together at a promotional price), all products that were purchased by together with the returned product as part of such a promotional set (i.e. the entire promotional set is subject to return).

    12. The Seller withholds the reimbursement of payments received from the Customer until receipt of the goods back and assessment of its actual condition.

    14. The customer is not entitled to withdraw from the contract:

    a) in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to meet his individual needs. In the described case, the right to withdraw is also not granted to a User who is not a customer.

    b) in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.

    15. The exchange of goods consists in returning the received products under the terms of withdrawal from the contract, and then placing a new order according to the new customer specification.

    § 13.

    Free eye examination in salons

    1. As part of the Free Eye Exam, Paris Optique offers an eye test to help you choose corrective glasses.

    2. As part of the Free Eye Examination consisting in the eye examination referred to in sec. 1 includes the following steps:

    a) Interview:

          • defining visual expectations and needs

    b) Initial assessment:

          • preliminary determination of refraction using an autorefractometer,

          • verification of the existing optical correction and assembly parameters of spectacle lenses;

          • determination of visual acuity with the current optical correction (Vis c.c.) and/or without optical correction (Vis s.c. - if appropriate)

    c) Determination of refraction using a phoropter and/or an ophthalmic cassette;

    d) Specify corrections for close and intermediate distances (if applicable)

    e) Selection of optical correction in the field of spectacle lenses:

          • verification of binocular distance vision comfort

          • verification of the comfort of binocular vision at close distances

          • recommendation of products adapted to the patient's visual needs (lenses: single vision, progressive; surface refinement)

    f) Discussing the essence of correction changes, related visual benefits, possible temporary adaptation symptoms and time of adaptation to correction.

    g) Schedule a follow-up visit.

    3. The actual list of activities performed during the Research, indicated in paragraph 13 section 1-2 above, depends on the Specialist's decision at the time of the examination and results from the need to ensure the most appropriate examination, taking into account the individual needs of the client.

    § 14.

    Booking a Study

    1. Paris Optique offers customers the option of booking a visit to a selected Salon for a Free Eye Exam.

    2. Reservation of the date of the Visit is possible through the electronic booking system for Visits on the Internet Platform, i.e. through the website of the Internet Platform at: https://parisoptique.pl/kalendarz/;

    3. In the case of booking the date of the Visit via the Internet Platform, the Customer may book the date of the Visit as:

    a) Registered Customer – after registering an Account on the Online Platform and logging into your Account; or

    b) Guest – without the need to register an Account on the Online Platform.

    4. Booking the date of the Visit on the Internet Platform is free of charge.

    5. For the correct booking of the date of the Visit, it is necessary to provide the following data:

    • indicating the city and showroom

          • contact email

          • name and surname of the tested person;

          • mobile number to contact

          • and confirming that you have read the Regulations of the store and the Privacy Policy and accept their provisions.

    6. For the avoidance of doubt, Paris Optique informs that the telephone number and e-mail address provided by the Customer will be used by Paris Optique only in connection with booking the date of the Visit, including sending confirmation of booking the date of the Visit, or reminders about the date of the Visit.

    7. After booking the date of the Examination, the Customer's e-mail address (provided by the Customer in the Appointment booking form) will receive an e-mail confirming the appointment of the Appointment by the Customer.

    8. The customer has the option of booking an appointment for any available date on which the optometrist is available. The Client has the right to cancel or change the date of the Visit without any consequences.

    9. Paris Optique reserves the right to change the work schedule of Specialists.

    10. For the avoidance of doubt, Paris Optique informs that the Free Eye Examination service is limited and is offered only to Customers booking a Visit via the Online Platform https://parisoptique.pl/.

    § 15.

    Complaints

    1. The customer may submit a complaint to Paris Optique regarding the operation of the Internet Platform, on the terms set out below. These provisions regarding complaints in no way exclude, limit or suspend the Customer's rights under the provisions of the Act governing the liability of Paris Optique for the lack of conformity of the sold goods with the contract.

    2. Each Customer may submit a complaint about the operation of the Internet Platform. The complaint should be submitted to Paris Optique within 14 days of the event giving rise to the complaint. Complaints should be submitted by e-mail to the following address: contact@parisoptique.pl

    3. The customer is obliged to complete the COMPLAINT FORM FOR GOODS PURCHASED IN THE ONLINE STORE, which is available download here and return the product.

    4. The returned goods should be sent individually via a courier or Polish Post to the following address:

    5. The complaint should contain:

    • name and surname of the advertiser;

    • email address for correspondence;

    • description of the reason for the complaint;

    • original proof of purchase (receipt/invoice)

    6. Complaints considered by Paris Optique within 14 (in words: fourteen) days from the date of receipt of the product together with the COMPLAINT FORM OF GOODS PURCHASED IN THE ONLINE STORE. The customer will be informed about the complaint decision by mail to the e-mail address created in the complaint.

    7. The rules and conditions for submitting complaints and using the loan, from the regulations providing for Paris Optique's liability for non-compliance of the goods sold with the external can be found in the Paris Optique Guarantee Conditions, available on the website, under https://parisoptique.pl/warunki_warunki

    § 16.

    Warranty

    1. Products sold by Paris Optique on the Paris Optique Online Service are covered by a one-year warranty (12 months) from the date of purchase shown on the proof of purchase (receipt/invoice).

    2. The exercise of warranty rights does not limit the Customer's rights under the warranty and other applicable laws.

    § 17.

    Personal data and their processing.

    1. Customers' personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95 /46/EC (general regulation on data protection) of April 27, 2016 (Journal of Laws UE.L No. 119, p. 1) and the Act on the Protection of Personal Data of May 10, 2018 (Journal of Laws of 2018, item 1000). The administrator of personal data is “Optyk Serwis i Marketing Sp. z o.o.” with its registered office in Warsaw, ul. Pory 78, 02-757 Warsaw, NIP 521-36-35-251

    2. All information referred to in art. 13 of the GDPR, Paris Optique provides the Customer with the transfer of personal data by the above-mentioned persons in paper or electronic form by providing information on the principles of personal data processing under the Privacy Policy accepted by the Customer, availablej at: https://parisoptique.pl/rodo_en

    In particular, Paris Optique processes Customers' personal data as part of the Internet Platform in order to perform the contract for the provision of electronic services, to maintain the Account and to be able to place and fulfill orders placed via Internet Platform – depending on which functionalities of the Online Platform the Customer uses. The detailed purposes and scope of the processed data are described in the Privacy Policy.

    3. Information about the rights of the data subject in connection with the processing of his personal data by Paris Optique is available in the Privacy Policy, at: https://parisoptique.pl/en_cookies

    § 18.

    Additional functionalities Paris Optique online

    1. The system offers the Customers the following additional functionalities:

    • Editing personal data provided by the Customer during Account registration,

    • Add the selected product to the clipboard,

    • Add selected product to Compare,

    • Sharing the selected product with a friend.

    2. The use of the above-mentioned functionalities and facilities may depend on the registration of an Account on the Online Platform.

    3. In addition, in the case of Customers who have an Account on the Internet Platform, each Customer may edit the data provided as part of the Account in the Paris Optique Service online (using the Account Form),

    4. The functionalities referred to in par. 3 above, do not affect the Customer's rights under generally applicable law, including in particular the right to access, control and change personal data processed by the Administrator.

    § 19.

    Final Provisions

    1. Paris Optique may amend the provisions of the Regulations in relation to Customers already using the Internet Platform in the following cases:

        • the need to adapt the Regulations or the Paris Optique online Service provided to generally applicable laws,

        • expansion of the Paris Optique Online Service or the Internet Platform with new content, functionalities or services that positively affect the Customer's rights or the ability to use the Internet Platform,

        • the need to change the functionality or the way the Online Platform works due to the desire to increase the security of the Online Platform, and in particular to increase the security of the Customer's personal data and other content contained on the Online Platform,

        • changes in the structure of the Internet Platform, aimed at facilitating the Customer's use of the Paris Optique Service online, while in no case resulting in the Customer's obligation to incur any costs on the Customer's side.

    2. Subject to the provisions of paragraph 19 sec. 4 below, in the absence of acceptance of the amendments to the Regulations, the Customer should stop using the Online Platform or submit a request to delete his Account,

    3. For the avoidance of doubt, we confirm that orders placed before the date of amendments to the Regulations will be implemented on the basis of the provisions in force on the date of placing the order by the Customer.

    4. If the change referred to in paragraph 19 sec. 1 above, significantly and negatively affects the Customer's access to or use of the digital service, the Customer may terminate any contract for the provision of digital services by Paris Optique online Services under these Regulations, to which the change applies without notice within 30 days of the date of introducing this change or 30 days from the date of informing the Customer about it in the manner described in these Regulations (whichever date is more favorable for the Customer).

    5. These Regulations can be found on the website: https://parisoptique.pl/regulamin. In addition, it can be printed or saved using the normal functions of your web browser.

    6. Please be advised that Paris Optique Services does not use alternative methods of resolving disputes with consumers, unless expressly required by applicable law. Therefore, we do not consent to and are not obliged to participate in out-of-court dispute resolution proceedings with consumers.

    7. Unless the mandatory provisions of law provide otherwise, the law applicable to the entire contract between the Ordering Party and the Store is Polish law. Any disputes arising from the application of these Regulations will be settled by the competent Polish common courts.

    It is possible to use out-of-court means of dealing with complaints and pursuing claims, such as mediation, conciliation or arbitration, if in a given case the Store and the Ordering Party agree to it.

    8. None of the provisions of these Regulations exclude or limit, to any extent, the rights of consumers under applicable law, nor can they be interpreted in such a way.

    In the case of entrepreneurs purchasing goods in the Store for purposes directly related to their business or professional activity, the relevant regulations of the Civil Code apply.

    9. The Statute are subject to Polish law.
